No charges against UD students

Madison County Prosecutor Steve Pronai will not file criminal charges against 80 University of Dayton students who trashed a local mini-mart during an apparent drunken spree in November.

Pronai said his decision was based on a lack of solid evidence.

“There was no specific incident that could be tied to a specific person,” Pronai said. “They all appeared intoxicated, but no one was (blood-alcohol) tested.”

Two busloads of students affiliated in some way with the university’s Sigma Chi fraternity stopped at Lake Side Plaza, 3180 Old Columbus Rd., about 5 p.m. on Nov. 17 for a “potty break.” The group was returning home from Columbus.

Madison County Sheriff’s deputies responded to a 9-1-1 call about 5:25 p.m. and found people running in and out of the business, breaking bottles, opening cans and urinating openly. Some also “flashed” customers in the parking lot and allegedly had sex in the dumpster.

Four men who said they were in charge of the group paid the business for damages before the buses headed to Dayton.

However, the 80 students involved may yet suffer consequences.

University spokesperson Cilla Shindell said Thursday campus police are wrapping up a separate investigation of the incident.

“The university expects to move forward with a disciplinary hearing in mid January,” Shindell said.

She did not provide specifics about what action the university might take against the students involved

    REALLY? So the business owner has to cover the expense because our County Prosecutor couldn’t make a decision was because of lack of solid evidence? The story does say “criminal charges against 80 University of Dayton students” and he throws it out because,….Because our county prosecuter can’t do his JOB!!!

    VERY DISAPPOINTING, now there’s at least 60% of these 80 students thinking they can get away with this type of behavior in the future.

    I simply cannot believe this! These students committed several offenses and did not get charged with anything??? Are you kidding me? I guess it’s okay for underage drinking, public intoxication, public indecency, and vandalism in Madison County. What a sad statement that sends out to our community. I am truly disappointed these people were not charged. I have to ask Pronai what else they would have had to do to get charged? They already violated several laws and disrespected our community. This is absolutely ridiculous.

    I once again the top officials have failed the citizens of Madison county. When are you people going to realize the republican led system in the county is failing you and not protecting your best interests. I wonder who’s bank account got fatter on this case.
