Sesic receives 30 months in jail

Regardless of the circumstances, Dale Sesic’s decision to drive drunk Feb. 3 resulted in the taking of Marilyn Payne’s life.
Sesic, of 110 Cedar Drive, London, was sentenced Thursday morning to 30 months in jail. He also was ordered to pay Payne’s family $43,600 in restitution. In addition, Sesic’s driver’s license was revoked for life.
Sesic, 53, pleaded no contest in Madison County Common Pleas in May to the aggravated vehicular assault charge. He admitted he was speeding northbound in response to a family emergency when his Hyundai Elantra rear-ended a parked 2007 Hyundai Accent with Richard Payne, 72, at the wheel. The Accent flipped over, striking Payne’s ex-wife, Marilyn, 69, who was picking up cans in an adjacent ditch. She was rushed to a hospital, but died within hours.
Sesic, who had five previous OVIs, told Payne’s family he was sorry Thursday morning.
“I am very sorry about what happened,” he said. “I’m devastated by it. I can’t get the accident scene out of my mind. It really, really weighs on me and I am truly sorry.”
Sesic’s attorney said his client believed he was in “complete control” of his vehicle when the accident happened. He also mentioned that a third car, a white SUV, was involved, but its driver didn’t stop.
Common Pleas Court Judge Robert D. Nichols accepted that a third vehicle may have been involved but said Sesic was driving drunk nevertheless. Moreover, it wasn’t the first time.
“There may have been mitigating circumstances, but you were driving 70 miles an hour under the influence of alcohol,” Nichols said.
